Darbys logo
The members of Darbys' Agriculture team have detailed knowledge of a wide range of aspects of agricultural law. The team spans our property, commercial and private client teams and can therefore advise you on such matters as commercial and residential property sales and purchases, the constitution of farm partnerships and other business entities, tax planning and the administration of estates, to name just a few examples.

As we are a multi disciplinary team we can give you wide ranging advice on all aspects of any transaction taking a holistic view. For example, we can advise you on how your property transfer could affect your estate and set up an appropriate company or family trust structure so that you maximise your reliefs and ultimately save money.

GREEN

We are pleased to offer a user friendly and, we believe, unique scheme for the agricultural community to ensure that we give the best service in all sectors. "GREEN" is easy to join and details can be found on our brochure in the "Download" area of this website.

Would GREEN be of benefit to you?

Are any of these questions familiar?

1. I have a cottage on my farm which is currently subject to an agricultural tie. The property is now vacant and I would like to sell the cottage. What is the process to try to remove the agricultural tie?

2. If I diversify into another business, what are the advantages or disadvantages of setting this up as a business separate from the main farm? Do I need planning permission if I am going to open a farm shop? What implications will this have for Inheritance Tax relief

3. Who will look after my farm if I am unable to do so? How do I plan for all my family’s needs in the future? How can I minimize any future tax?

4. I have been approached by a telecoms company to put a mast on my land. They have offered me an upfront payment to start work with the legals to follow. Is this a sensible way to proceed?

5.How is it best to set up a joint venture? For example, if I am going to develop a business using another's expertise (perhaps waste management), who will control or manage the joint venture?

6. I have a farm worker who has retired. Do I have to continue to offer him accommodation? Can I charge a market rent?

7. I have been stopped by the police whilst transporting livestock. What regulations should I be complying with?

8. I have seasonal workers arriving from abroad. Do I have to house them? What employment rights do they have? Do I need to obtain Visas for them?

9. I would like to rent out cottages for holiday lets – will my estate still be eligible for Inheritance Tax Relief on my death?

10. Who do I contact if your pesticide holding tank leaks into nearby water courses?

11.What if my cattle escape onto the road and cause an accident? Am I liable?

These are just a few of the problems and queries which we can help you with.
