When you purchase goods or services from a business you are protected by the express terms of that contract (eg terms that say what the goods or services will be, what you will pay, what the spec of them is, and so on) and by some terms that are implied into that contract by law. So, if you are buying goods, then unless it has been specifically excluded there will be an implied term in the contract that the goods will be of satisfactory quality and fit for their usual purpose, etc. If you are buying services rather than goods, there will be an implied term that the services that you are buying will be carried out with reasonable care and skill by the business that you are buying those services from.
If the goods or services supplied are not in accordance with the terms actually set out in the contract, or are in breach of the terms that are implied into the contract, then if the person who sold them to you will not repair the situation voluntarily, the law can help you to obtain what the agreement said that you would obtain.
Your claim against the supplier of the defective goods or services can be for rejection of the goods (whereby the goods go back to the supplier and you recover your money), damages (ie money, such as the cost of repairs, to put you back in the position you would have been in had the contract been properly performed), or for what is called "specific performance" (whereby the Court orders the supplier to complete the contract properly).
Usually, where your claim is for a sum of money greater than £5,000, you will also obtain an Order that the party that has supplied the goods in breach of the express or implied terms of the contract pays the majority of your legal costs.
