No individual or business can use or exploit your intellectual property without your permission. That intellectual property might consist of a name, a design you have made, your "trade secrets”, or maybe a web domain.
If it comes to your attention that someone is using your intellectual property without your permission, there is action you can take to prevent that use continuing. We can take that action on your behalf.
Usually these matters are urgent. Our first step is to contact the other side immediately asserting your rights, demanding that they stop the use immediately, and also demanding that they give undertakings to you that they will, firstly, stop using your intellectual property and, secondly, that they will account to you (ie - pay you) for any profits which they have made from the use of your intellectual property.
If the user continues to use your intellectual property without your permission you can apply to the Court for an injunction and also for damages. The injunction is to stop the use continuing and the damages are for the user to compensate you for any profits which they have made from your intellectual property and any losses which you have suffered from them using your intellectual property.
Such court action can be started very quickly and if you can show the court that the use of your intellectual property is wrongful, the court will grant an injunction that stops the other side doing what they are doing.
However, that will just be an "interim” injunction, as at the same time you also have to start a full court action against the other side to resolve the question by a full hearing in front of a judge once and for all. At that final hearing hopefully the judge will make the interim injunction a "final” injunction.
