We were approached by a trust in relation to a piece of unregistered land who wanted to change their trustees. Due to an existing charge over the land, a transfer of the charge from old to new trustees was necessary. Registration of unregistered land is required with any transfer of charge. In order to save our client time and money, we were able to register the land with the land registry in conjunction with the registration of the new charge.
We acted for a bank in the refinancing of substantial assets held by a family trust of circa £3 million. As further funds were being raised which were only applicable to some of the members of the trust we negotiated a deed with the individuals that ensured that the bank only had recourse to part of the value of the property.
We acted for Mr C who had already exchanged contracts to buy property overseas and needed to raise funds urgently via a charge over his farm in order that he could complete. We acted speedily for him and the commercial lender to ensure that funds were released enabling him to complete the purchase of the foreign property.
