We have extensive experience in acting for both landlords and tenants in the grant of Farm Business Tenancies. Most importantly we will always find out what your aims are in taking the tenancy and also we will ensure that we understand your business and what is or might become important to you now and in the future.
Once we have that understanding, we can help you to negotiate terms with your landlord that suit your operational needs and that minimise cost and risk to you over the lifetime of the lease.
Issues that we explore with you include -
• What are you going to use the leased premises for?
If you are taking a tenancy of arable land or land for stock we will make sure there are no restrictions that prevent you from operating as you anticipate and, if there are, we will advise you of your options and how to manage any problems.
• Money!
We will make sure that you go into a tenancy with your eyes fully open, and that there are no surprises which might give rise to unforeseen costs or liabilities for you. We also appreciate the need to keep a tight reign on legal costs so we try to give you a fixed price (which we stick to) and we always give you regular costs updates.
We can also assist with the transfer of Single Farm Payments and have a wide range of excellent land agent contacts who we could recommend for advice on registration with appropriate schemes for extra income streams for your business.
• Are you or the landlord doing any works to the property?
If you are carrying out work and incurring expenditure then we would discuss with you how this will tie in with the rent you pay and what you will need from your landlord before carrying out any works.
Furthermore, we will ensure that you have the right protections in place if your landlord has agreed to carry out work on the premises prior to your tenancy commencing.
• When are you planning the move?
We often work to very tight timetables and are aware that sometimes when you are moving out of somewhere else, you will have no flexibility. We will work with you to make sure that your timescale is achieved.
These are just some of the main issues that we deal with when dealing with farm business tenancies.
