Utility Companies and Easements Over Your Land

Perhaps you have been approached by an electricity company asking for a right to lay cables on your land or a Water Company wants to install drainage or water supply pipes.  In such cases the Utility Company would usually agree to pay you a premium plus your legal and surveyor's fees in the grant of a "Deed of Easement”. There may also be an annual fee or rent payable to you in some arrangements.

We would be able to either draft the Deed or amend the Deed provided by the Utility Company, taking your particular requirements into account. We would explain the issues, such as any consequent restrictions on what you can do with the land, and make sure that you were happy with the arrangement you are entering onto. For example such a Deed may restrict building in a particular area or may require that you do not cultivate land over the easement route, so you need to be fully aware of such restrictions before committing yourself.

Other issues to consider are:

  • Will you receive a rent?
  • How long is the arrangement for?
  • What rights and obligations do each party have?
  • What happens if the Utility company goes into administration or sells its interest to another party?
  • How will your land be restricted?

In any event, we will always guide you through the issues and make sure you are happy with what you finally agree before you are committed.
