We acted on behalf of a major landowner in the grant of a deed of easement over farmland to permit the local water company to construct a drain into an existing outfall. The deal involved payment of compensation for loss of crops to the farm tenant and the surrender of a strip of land from the farm tenancy, tied in with a consent from the tenant's lender to the transaction. The easement was drafted by the Water company but adapted to protect both the tenant's and our client's interests.

 

 

We acted for the freeholder of a large rural estate when he was approached by a local electricity supplier to install power cables to serve a new residential development of over 50 homes that was under construction. The easement was over land tenanted by both an Agricultural Holdings Act Tenant and a Farm Business Tenant so a deed of surrender for the affected land was put in place with the Farm Business Tenant and the AHA Tenant, having a much more secure protected interest, became a party to the easement. We acted with the tenants' land agents to secure the best outcome for all parties, including payment of compensation for loss of crops, single farm payments and use of the land for the duration of the construction works.
