Lung cancer can be caused by asbestos exposure, or by a combination of asbestos exposure and cigarette smoking, or indeed other factors. A particular form of lung cancer, mesothelioma, is almost always caused by asbestos, whilst other forms may be caused by a multitude of factors.
If the lung cancer is not a mesothelioma then while it is possible to prove that the lung cancer is due to asbestos exposure rather than other factors and so bring a compensation claim, certain additional factors need to be proved as well.
THE LEGAL ISSUES
At present under what are called the "Helsinki Criteria”, to bring a claim for you we have to prove one or more of six factors :
- the presence of asbestosis
- an estimated cumulative exposure to asbestos of 25 fibre years or more
- an occupational history of one year's heavy exposure or 5 - 10 years moderate exposure and a 10 year time lag between exposure and the onset of cancer
- a count of 5,000 - 15,000 asbestos bodies per gram of dry lung tissue
- uncoated fibre burden of 2 million amphibole fibres more than 0.005mm in length
- one million amphibole asbestos fibres more than 0.001mm in length
As you can see these are very detailed requirements that have to be met if we are to bring a claim for lung cancer on your behalf.
HOW MUCH IS YOUR CLAIM WORTH?
Compensation for lung cancer ranges between £50,000 and £70,000.
