Paying for care fees

We can help you through the complicated process of finding out whether you should be paying for your long-term care or whether you can get someone else to pay for it.

Some people will have to pay for their own care if they have a certain amount of money or assets.  Social Services will make a calculation to see if you should pay for yourself.  Others may be entitled to have others pay for their care - either their local authority or the NHS.

We can tell you whether you should be paying for your care, and if you should not, we can deal with the organisation which may have to pay for you.  Social Services will look into everything you own to calculate whether you should pay  for your care, but some of your property can be treated specially, including:

  • Your Home - Social Services must not include the value of your home in certain situations, for example where your spouse is living there or where a relative over the age of 60 is living there.
  • Property you own with someone else - If you own a property with one of your children, the value of your share of the house might not be included in the Social Services calculations.
  • Joint savings - Social Services can look at any joint accounts you have but they are not allowed to look at any accounts in the sole name of your spouse.
  • If you give away money or property so that you are in a better position to get Social Services to pay for your care, Social Services may be able to treat you as if you still owned the money or property.  This is a complex area of the law which we can help you with to protect your interests and assets.
