We were contacted by Mr D who advised that his employer had refused to recognise the fact that he was entitled to take annual leave following a lengthy period of absence.  We contacted the employer and successfully argued that entitlement to annual leave accrues during long term sickness absence and that Mr D should be able to take his full entitlement on or before his return.

Following a period of absence of almost 12 months, Miss H approached us for advice on returning to work on a phased return.  Her employer had resisted this on the basis that he considered that her role could not be done on a part-time basis.  We wrote to the employer reminding them of their obligations under the Disability Discrimination Act (now the Equality Act) and suggested what reasonable adjustments could be made following her return.  A phased return was agreed and adjustments were made.  In addition Miss H's employer agreed to pay for the cost of taking legal advice.
