Unfortunately, however, many civil partnerships do end in dissolution and many people are now taking advice even before they enter a civil partnership as to how to protect themselves and their assets in the event of a relationship breakdown. For some, getting an arrangement in place is the very comfort they need to enable them to proceed into civil partnership and all that goes with it. These are called Pre-Partnership Agreements.
A Pre-Partnership Agreement is a private agreement entered into by a couple prior to the registration of their civil partnership and is designed to record how the couple wish to resolve financial issues arising in the event of separation. A Pre-Partnership Agreement is thought by many to be a sensible way in which to avoid the uncertainty, costs and bad feeling which can often accompany the break down of a relationship
Pre-Partnership Agreements are not yet legally binding in this country but are seen as good evidence of the intention of the parties. This means that although the courts can be asked to consider Pre-Partnership Agreements they may not always be considered to be binding. Recent case law has determined that for a Pre-Partnership Agreement to have the best chance of being accepted by a court, a number of criteria should be met.
