If you live outside the UK

If you have applied for a visa to allow you to visit your family in the UK, and that application for a visa was unsuccessful, you will normally have 28 days in which to submit a notice of appeal. Depending on your circumstances, it might be easier and more effective to simply submit a fresh visa application. If you haven't applied to visit your family you won't, unfortunately, be able to appeal.

When your application for a visa has been refused, reasons will be given for that refusal.

By completing the notice of appeal you are indicating that you would like to appeal against the refusal and you can choose what form you would like your appeal to take. You can choose a written appeal, or an appeal by way of a Tribunal hearing.
 
The court hearing will take place in the UK and although your witnesses may be able to attend the hearing, you will almost definitely not be able to attend because you will be abroad.

You do not have to be represented at your appeal but it often assists if a lawyer can help in preparing the paperwork and in speaking on your behalf at the hearing. In preparing for an appeal, you have to address the specific reasons that were given for the refusal.

If you are inside the UK

If you have applied for permission to be in the UK and that has been refused, you can choose whether to appeal against the refusal in writing or whether to attend at an appeal hearing in person.  It may be helpful to receive assistance in preparing the paperwork and to have a lawyer at the appeal to speak on your behalf.
