Staying in the UK permanently
Back
Depending on how long you have lived in the UK, and depending on what you have been doing during your time here, you may be able to apply for permission to live in the UK permanently. This is called an application for "settlement”.

For example :

  • If you have worked in the UK continuously for a period of five years - perhaps as a work permit holder or as a Tier 1 Highly Skilled Worker - then you may be eligible to make an application for settlement.  You will need to provide information about your life and work over the last five years and you must pass a test called "Citizenship - Life in the UK”.
  • Even if you haven't worked in the UK for five continuous years but you have lived legally here for ten years (maybe as a student or first as a student and then as a worker) you may still be eligible to make an application for settlement.  You have to have lived here continuously during that ten year period and will need to provide information about what you have done and where you have been during that ten year period.
  • European Economic Area Nationals and their dependants should be eligible for permanent residence in the UK once the EEA National has lived and worked in the UK for a period of five years.
  • If you have lived here for fourteen years or more, even if for some of that time you have not been here legally, you may also be eligible to apply for permanent settlement.

As you can see, there are a range of scenarios in which someone can apply for permission to live in the UK permanently.

All you need to do - if you wish to explore whether you are eligible for permanent settlement in the UK, and to get help in completing your application and all supporting documentation - is to speak to our Immigration Law team.
