We advised a gentleman who had suffered clear discrimination in the workplace on the basis of his sexuality, which led him to resign.  The gentleman was advised on the law of constructive dismissal which allows an employee to bring a claim against the employer for unfair dismissal.  In order for constructive dismissal to apply there must be a fundamental breach of contract by the employer which left the employee feeling forced to resign.  In this case, being told that he was not capable of dealing with female customers because he is a gay man had the hallmarks of a fundamental breach.

A civil partnered female couple came to us to prepare their Wills and put their affairs in order.  In addition to taking instructions on the preparation of their Wills and transfer of property, advice was also given on the benefits of having living Power of Attorneys put in place as well as setting up Trusts to cater for any future children that the couple might have.

 

Our criminal team advised a gentleman at the police station who was unwittingly caught up in a bomb-hoax at Heathrow Airport caused by his disgruntled civil partner.  The story made the Evening Standard and the national gay press.  Regrettably, due to a potential conflict of interest, we were unable to also act for the husband who was later arrested by police.  Our client was released without charge.
