Mr B sustained a back injury whilst lifting a heavy object at work. Although Mr B had a pre-existing back complaint, the medical evidence collated clearly showed that the accident had accelerated the onset of a previously asymptomatic condition. Although account had to be taken of Mr B's pre-existing back complaint, the claim was settled at £60,000.
Mr P worked as a machine operator and specialised in the manufacture of plastic window sills for a double glazing company. In the course of loading the window sills onto the distribution lorry, Mr P slipped on some of the plastic material used to make up the sills, which had been left scattered over the warehouse floor. In falling to the ground, Mr P fell heavily onto his lower back causing significant pain and discomfort. Although Mr P had a pre-existing back problem, he had not experienced any pain for some time before the accident. Taking into account Mr P's pre-existing back complaint, the case was settled for £40,000.
