Getting nowhere with her family Solicitors Ms G came to see us about selling her late mother's flat. When we looked at the title deeds we were astonished to see that the Lease did not include ownership of a balcony or a second bedroom. We managed to discover that the problem arose from when Ms G's mother bought the flat 25 years ago from the Local Authority. We immediately made contact with the Council's Legal Department and asked them to investigate. After several months delay, the Council eventually admitted that the plan it had prepared 25 years ago was wrong, and arranged for it to be updated - at no cost to Ms G - at the Land Registry. We were able to exchange Contracts for the sale of the flat the next day.
We were instructed by Mr and Mrs S in relation to the sale of their flat in London. When we asked to see copies of the service charge accounts Mr and Mrs S told us that no repairs has been carried out to the building for several years. In fact, Mr and Mrs had had no contact with the Management Company whilst they had owned the flat. Our enquiries revealed that the Management Company had in fact been dissolved at Companies House several years ago and as a result the flat could not now be sold. We contacted the Treasury Solicitor and eventually made an application on behalf of our clients and the other residents to restore the Management Company which was duly granted.
Mr B asked us to help him with the sale of his flat, but was worried that the lease was too short. Although he was entitled to have the lease extended, Mr B said he did not have the money to do this. As Mr B had owned the flat for many years, we advised him to serve a formal Notice on his landlord claiming his right to extend the lease. We were then able to agree terms with the landlord without having to go to Court. Armed with this information we ensured that the benefit of the Notice would be transferred to the buyer on completion of the sale. On completion the buyer paid the landlord directly for the lease extension so Mr B was able to move on afterall, and at no additional cost.
