 Who can administer the intestate's estate?

The person responsible for dealing with the deceased's affairs is called the 'Personal Representative'. Under the intestacy rules, this person will be one of the following, in the following order - it's first come, first served!

  • the spouse or civil partner of the deceased
  • the deceased's children (if aged over 18) or grandchildren (if aged over 18)
  • the deceased's parents
  • the deceased's brothers or sisters, or their descendants
  • the deceased's half brothers or sisters, or their descendants
  • the deceased's grandparents
  • the deceased's uncles and aunts
